Estate planning requires a methodological and structured process. We assist clients with planning their estate through a considerate approach based on factual and circumstantial considerations. This includes the identification of assets where the interpretation of public registry searches may sometimes be required, identification of intended beneficiaries as recognised by Maltese law and the manner in which the estate may be split up. We further assist clients with the preparation of the will and the restructuring of the estate by means of trusts and partnerships.
According to Maltese law an individual may prepare two types of wills. A public will which is published by a notary and is enrolled in the central registry in Malta (public registry). A secret will, on the other hand, is not enrolled in the central registry but is deposited at the registry of the Maltese courts giving it its obscure nature.
We also assist clients in any litigation proceedings relating to the devolution of an inheritance including claims on the estate and claims for the reserved portion.
